House Approves Dependent Care Assistance Plans Rollover

On June 22, 2004, the House approved, by a voice vote, H.R.4372 to allow a $500 rollover of unused funds for Dependent Care Assistance Plans (DCAPs).It has been received in the Senate and referred to the Committee on Finance. Rep. Cantor (R-VA) is trying to find a Senate sponsor for the legislation.

Other proposed legislation affecting DCAPs that are pending in the House Ways and Means Committee for action are:

  • HR 4379, introduced by Rep. Tammy Baldwin (D-WI),which proposes to increase the $5,000 limit to $6,000 and to add an annual cost-of-living increase.
  • HR 3666, introduced by Rep. Sanford Bishop (D-GA) which proposes to increase the age of eligible DCAP dependents from 13 to 15.
  • HR 4132, introduced by Rep. Amo Houghton (R-NY), which simplifies the child definition.(Sen. Max Baucus has introduced a similar bill, S 755, Uniform Definition of Child Act, now pending in the Senate Finance Committee.)
